Judge Arleo Cox of the United States District Court for the District of New Jersey has sustained KL’s lawsuit against RJW Barnabas Health and denied RWJ’s motion for arbitration. This means that all the legal claims in the case can now proceed in court. The case asserts that RWJ rounds hourly workers time so that if the worker punches in seven minutes before (or after) their shift starts, the time is “rounded” – a practice that almost invariably leads to RWJ benefitting from the “rounded” time, time that the employee has lost and not been paid for. The same is true at the end of shifts where the seven minute rule also applies. KL, and our co-counsel, Scott & Winters, believe that workers are underpaid potentially millions of dollars as a result.
